The Hon'be Gujarat High Court in X v. State of Gujarat & Ors granted a woman government employee one week’s leave, in addition to her entitled leave, after she filed a sexual harassment complaint under the PoSH Act. Though the inquiry had concluded, the Court noted that the alleged perpetrator was still seated next to her. The leave was granted pending a decision on her representation seeking transfer. Citing the legislative intent behind Section 12 of the POSH Act, Justice JL Odedra emphasized that forcing the complainant to work beside the harasser defeats the law's purpose. The Hon'ble Supreme Court, monitoring implementation of its December 3, 2024 directions under the PoSH Act, noted full compliance by all States and UTs in appointing District Officers. However, some gaps remain in the constitution of Local Committees and Internal Committees, particularly in Delhi, Haryana, Jharkhand, and Kerala. States have been directed to file additional affidavits. While most States have conducted surveys on Internal Committees in both government and private sectors, concerns remain regarding data accuracy. Ambiguity persists about Nodal Officer appointments under Section 6(2) of the Act versus those for SheBox.
